1. Who We Are

This Shop is operated by Siel Watersports SL, tax ID (CIF) B13931852 (EU VAT / TVA intra. ESB13931852), registered office at 16 Calle Cangrejo, 35660 Corralejo, Spain.

2. Products & Prices

All prices are displayed in euros (€) and include applicable VAT (IGIC where relevant for the Canary Islands). Prices exclude shipping costs, which are calculated and shown at checkout before payment.

Product photos are as accurate as possible, but colours may vary slightly depending on your screen. We reserve the right to correct pricing or description errors at any time, including after an order is placed, and will notify you before proceeding if this affects your order.

All products are subject to availability. If an item becomes unavailable after you order it, we will inform you and offer a refund or a suitable alternative.

3. Placing an Order

Add the products you want to your cart, choose the correct size and colour, and complete checkout with your delivery and payment details. You will receive an order confirmation by email once your payment is successfully processed — this confirms the sale contract between you and us.

Please check your order carefully before confirming payment. Contact us as soon as possible at siel@sielkite.com if you notice an error — we can amend or cancel an order only before it has shipped.

4. Payment

We accept credit and debit cards, Amazon Pay, and Link, processed securely by Stripe. We do not store your full card details on our servers — payment data is handled directly by our payment provider.

Your order is confirmed and processed only once payment has been successfully authorised.

5. Shipping & Delivery

Orders ship within 48 hours from our shop in Fuerteventura, Canary Islands, subject to stock availability. Delivery times vary by destination and are estimates, not guarantees — they may be affected by customs processing, carrier delays, or events outside our control (see Section 11, Force Majeure).

Shipping costs are calculated at checkout based on destination, weight, and package value, and shown before you confirm payment.

Risk of loss or damage to products passes to you once the order is delivered to the address you provided. Please inspect your parcel on arrival and report any damage to siel@sielkite.com within 48 hours.

6. Right of Withdrawal

As an EU consumer, you have the right to withdraw from your purchase within 14 calendar days from the day you (or someone you designate) receives the goods, without giving any reason.

To exercise this right, contact us at siel@sielkite.com with your order number before the 14-day period ends. You must then return the goods within 14 days of informing us, at your own cost unless the item is defective or incorrect.

Returned items must be unused, unworn, in their original condition and packaging, with tags attached. Items that are personalised, made to your specification, or that have hygiene seals broken (where applicable) are excluded from the right of withdrawal, as permitted under EU law.

7. Returns & Refunds

Once we receive and inspect your returned item, we will notify you by email whether your refund is approved. Approved refunds are issued to your original payment method within 14 days of us receiving the returned goods, and include the original delivery cost (but not the return shipping cost, unless the return is due to our error).

If an item arrives damaged, defective, or different from what you ordered, contact us at siel@sielkite.com with photos — we will arrange a replacement, refund, or free return at our cost.

8. Legal Warranty

All products sold include the legal guarantee of conformity provided under EU and Spanish consumer law (currently 3 years from delivery). If a product turns out to be faulty or not as described, contact us at siel@sielkite.com — remedies may include repair, replacement, price reduction, or refund, as applicable by law.

9. Intellectual Property

All content on this Shop — including the Siel and Jacobsen Kite names, logos, product photography, and site design — is owned by us or our licensors and protected by intellectual property law. You may not reproduce, redistribute, or use this content commercially without our prior written consent.

10. Limitation of Liability

We are not liable for indirect or consequential losses arising from your use of products purchased through this Shop, except where such liability cannot be excluded under applicable law (for example, death or personal injury caused by negligence, or fraud).

Nothing in these Terms limits your statutory rights as a consumer under EU or Spanish law.

11. Force Majeure

We are not liable for delays or failure to perform our obligations due to events beyond our reasonable control, including:

• Extreme weather, natural disasters, or transport strikes
• Customs delays or import restrictions
• Political instability or pandemic-related restrictions

12. Data Protection

Your personal data is processed in accordance with our Privacy Policy, in compliance with the GDPR and Spanish data protection law. We use your data only to process your order, manage delivery, and communicate with you about your purchase.

13. Complaints & Dispute Resolution

If you have a complaint, contact us first at siel@sielkite.com so we can try to resolve it directly.

As an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr to submit a complaint.

14. Applicable Law & Jurisdiction

These Terms are governed by Spanish law. Any dispute will be submitted to the courts of Las Palmas, Spain, without prejudice to any mandatory consumer-protection rights that entitle you to bring proceedings in your own country of residence within the EU.

15. Acceptance

By placing an order through this Shop, you confirm that you have read, understood, and accepted these Terms and Conditions of Sale.
